I. General provisions

1. This privacy policy specifies how the personal data of Users necessary for the provision of electronic services via the Website www.amberbluevillas.com are collected, processed and stored (hereinafter referred to as: Website) are collected, processed and stored.

III. The purpose of collecting personal data

1. Personal data is used for the following purposes:

   • enabling logging in to the Website,
   • performance of the contract regarding services and e-services,
   • communication with the User (live chat, contact form, etc.)
   • sending the newsletter (after the User has consented to receiving it),
   • maintaining a comment system,
   • providing community services,
   • promotion of the Controller's offer,
   • marketing, remarketing, affiliation,
   • personalising the Website for Users,
   • analytical and statistical activities,
   • debt collection,
   • establishing, pursuing or defending against claims.

2. Providing data is voluntary, but necessary to conclude a contract or use other functionalities of the Service.

IV. Type of personal data processed

The Controller may process the User's personal data: name and surname, date of birth, address, e-mail address, telephone number, Tax Identification Number (NIP).

V. Period of personal data processing

Users’ personal data will be processed for the period of:

• when the basis for data processing is the performance of a contract – until the limitation period for claims after its performance expires,
• when the basis for data processing is consent – until its withdrawal, and after the withdrawal of consent until the limitation period for claims expires.

In both cases, the limitation period is 6 years, and for claims for periodic benefits and claims relating to running a business – 3 years (unless special provisions provide otherwise).

VI. Sharing personal information

1. Users’ personal data may be transferred to: entities associated with the Controller, its subcontractors, entities cooperating with the Controller, e.g. companies handling e-payments, companies providing courier/postal services, law firms.
2. Users’ personal data will not be transferred outside the European Economic Area (EEA).

VII. User Rights

1. The Website User has the right to: access the content of their personal data, rectify it, delete it, limit its processing, transfer it, object to the processing, withdraw consent at any time (which does not affect the lawfulness of processing based on consent before its withdrawal).

3. The Controller shall comply or refuse to comply with the request immediately – at the latest within one month of its receipt.
4. The User has the right to lodge a complaint with the President of the Personal Data Protection Office if he/she considers that the processing violates his/her rights and freedoms (GDPR).

1. The Website collects information using cookies – session, persistent and those of external entities.
2. Collecting cookies supports the correct provision of services on the Website and serves statistical purposes.
3. The User can specify the scope of cookie access to their device in their browser settings.

IX. Automated decision-making and profiling

1. User data cannot be processed in an automated manner that could result in any decisions being made about them.

X. Final Provisions

1. The Controller has the right to introduce changes to the Privacy Policy, but the rights of Users will not be limited.
2. Information about the changes introduced will appear in the form of a message available on the Website.
3. In matters not regulated in this Privacy Policy, the provisions of the GDPR and Polish law shall apply.
